VietinBank Thanh An announces debt auction

Joint Stock Commercial Bank for Industry and Trade of Vietnam- Thanh An Branch (Vietin Marina City) announced to hold the 2nd auction for the debt of Cruise Hotel Joint Stock Company (CHR).

I. Information on the debts to be sold by auction

1. Debts to be sold by auction

- Assets to be sold by auction include the full amount of debts (principal, interest and interest on overdue debt principal) of Saigon Marina Hotel Joint Stock Company at VietinBank Thanh An which arose from Investment project loan agreement No. 25/2018-HĐCVDADT/NHCT320-BDT dated 30/5/2018 and loan agreement amending and supplementing documents.

- The total outstanding debt as of 16/1/2024 is VND 646,402,238,698 (in words: six hundred forty-six billion, four hundred two million, two hundred thirty-eight thousand, six hundred ninety-eight). Including:

+ Outstanding principal: VND 485,938,282,754.

+ Interest payable: VND 160,464,000,944. Including: interest within the term: VND 155,306,511,253; penalty interest: VND 5,157,489,691

2. Secured assets (SA) include:

2.1 SA 1:

- Right to use 5,965.5m2 of land and future-formed assets attached to the land located at: Area A, plot No. 8, Vinh Hoa Urban Area, Vinh Hoa Ward, Nha Trang City, Khanh Hoa Province according to the land use right certificate, house ownership right and other assets attached to the land No. CD 355465 issued by Khanh Hoa Provincial People's Committee on 06/06/2016, certificate of title issuance number: CT - 10772.

- This asset was mortgaged by the Company at VietinBank Thanh An under mortgage contract No. 49/2018HĐBĐ/NHCT320-BENDUTHUYEN notarized on 22/08/2018, mortgage registered on 22/08/2018 and subsequent mortgage contract amendments and supplements:

+ Amendment and supplement No. 65/2018/VBSĐ01/NHCT320-BENDUTHUYEN dated 30/10/2018 (reducing the mortgaged asset by future-formed apartments from 803 to 711 and the entire area of the Penthouse).

+ Amendment and supplement No. 75/2018/VBSĐ02/NHCT320-BENDUTHUYEN dated 22/11/2018 (reducing the mortgaged asset by future-formed apartments to 611 and the entire area of the Penthouse).

+ Amendment and supplement No. 85/2019/VBSĐ03/NHCT320-BENDUTHUYEN dated 05/03/2019 (reducing the mortgaged asset by future-formed apartments to 509 and the entire area of the Penthouse).

+ Amendment and supplement No. 95/2019/VBSĐ04/NHCT320-BENDUTHUYEN dated 10/07/2019 (reducing the mortgaged asset by future-formed apartments to 470 and the entire area of the Penthouse).

+ The amendments and supplements to the above Mortgage Contract have all been notarized and registered to change the content of the security measure that has been registered in accordance with regulations.

2.2 SA 2: All fixed assets in the Hoang Gia - Swisstouches Laluna Resort - Area A Marina Project according to asset mortgage contract No. 50/2018/HĐBĐ/NHCT320-BDT dated 20/08/2018 (Mortgage contract 50/2018), and amendments and supplements including but not limited to: machinery, equipment, furniture, tools and utensils, means of transport and other fixed assets in the Project.

+ Amendment and supplement No. 70/2018/VBSĐ01/NHCT320-BENDUTHUYEN dated 29/10/2018.

+ Amendment and supplement No. 86/2019/VBSĐ03/NHCT320-BENDUTHUYEN dated 05/03/2019.

2.3 SA 3: Property right of Marina Company arising from 60 apartment sale and purchase contracts signed between Saigon Marina Hotel Joint Stock Company and the apartment buyers. This asset was mortgaged by the Company at VietinBank Thanh An under property right mortgage contract No. 13/2018/HĐBĐ/NHCT320-BDT signed on 31/08/2018 and registered as a secured transaction on 23/04/2019.

2.4 SA 4: Property rights of Marina Company arising from 98 apartment sale and purchase contracts signed between Saigon Marina Hotel Joint Stock Company and the apartment buyers. This asset was mortgaged by the Company at VietinBank Thanh An under property right mortgage contract No. 14/2018/HĐBĐ/NHCT320-BDT signed on 01/10/2018 and registered as a secured transaction on 23/04/2019.

2.5 SA 5: Property rights of Marina Company arising from 23 apartment sale and purchase contracts signed between Saigon Marina Hotel Joint Stock Company and the apartment buyers. This asset was mortgaged by the Company at VietinBank Thanh An under property right mortgage contract No. 15/2018/HĐBĐ/NHCT320-BDT signed on 31/10/2018 and registered as a secured transaction on 23/04/2019.

2.6 SA 6: Property rights of Marina Company arising from 10 apartment sale and purchase contracts signed between Saigon Marina Hotel Joint Stock Company and the apartment buyers. This asset was mortgaged by the Company at VietinBank Thanh An under property right mortgage contract No. 16/2018/HĐBĐ/NHCT320-BDT signed on 30/11/2018 and registered as a secured transaction on 23/04/2019.

2.7 SA 7: Property rights of Marina Company arising from 19 apartment sale and purchase contracts signed between Saigon Marina Hotel Joint Stock Company and the apartment buyers. This asset was mortgaged by the Company at VietinBank Thanh An under property right mortgage contract No. 17/2018/HĐBĐ/NHCT320-BDT signed on 5/9/2018 and registered as a secured transaction on 30/08/2019.

2.8 SA 8: Property rights of Marina Company arising from 39 apartment sale and purchase contracts signed between Saigon Marina Hotel Joint Stock Company and the apartment buyers. This asset was mortgaged by the Company at VietinBank Thanh An under property right mortgage contract No. 18/2018/HĐBĐ/NHCT320-BDT signed on 8/10/2018 and registered as a secured transaction on 30/08/2019.

2.9 SA 9: Property rights of Marina Company arising from 24 apartment sale and purchase contracts signed between Saigon Marina Hotel Joint Stock Company and the apartment buyers. This asset was mortgaged by the Company at VietinBank Thanh An under property right mortgage contract No. 19/2018/HĐBĐ/NHCT320-BDT signed on 1/11/2018 and registered as a secured transaction on 30/08/2019.

2.10 SA 10: Property rights of Marina Company arising from 12 apartment sale and purchase contracts signed between Saigon Marina Hotel Joint Stock Company and the apartment buyers.
